As an Atlanta litigation support company with a team who has been around more than our fair share of lawyers, we know those in the legal field aren’t usually all that excited when it comes to IT solutions, eDiscovery, or the ever-changing landscape in general. For someone who isn’t an attorney, looking in from the outside while a group of lawyers engage in a discussion can be like listening to a foreign language and not understanding much at all, given all the legalese thrown around.
We know many attorneys, particularly those who are “old school,” would rather just keep on doing things the old fashioned way; technology is just something you really don’t want to deal with. The fact is, if your law firm is going to stay competitive, you’re going to have to adapt to eDiscovery and other technology just as you do to changes in laws, new precedents, and politics. You can do this!
Are you aware there have been eDiscovery malpractice cases? One example is a California case involving a manufacturing company vs. a law firm for an alleged eDiscovery misstep. No law firm wants to be sued for malpractice, so it’s vital for today’s modern law firms to ensure that, as an attorney, you’re open to eDiscovery education. The ABA (American Bar Association) Rule 1.1: Competence which states “A lawyer shall provide competent representation to a client. Competent representation requires the legal knowledge, skill, thoroughness and preparation reasonably necessary for the representation.” This rule was slightly amended by the ABA in 2012 to include wording regarding the changes in law and its practice, with these changes including the benefits and risks associated with relevant technology. Essentially, it’s your duty as a reputable attorney to have at least some knowledge in the area of technology, even if you aren’t all that tech-savvy and have no desire to be.
At Infinite eDiscovery we know it’s difficult transitioning to a technological world for those who’ve been used to the slow, manual, and methodic way of handling everything for years, perhaps even decades. As a litigation support company in Atlanta, you can rely on us for solutions to all of your legal needs, from consulting and CLE to eDiscovery workshops, electronic discovery, and more. Let us help bring you into the era of technology in a way that isn’t quite so painful!
